Welcome to QRForms. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and platform (collectively, the "Service") operated by QRForms Pvt Ltd ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Service.

You must be at least 18 years old to use our Service. By registering, you confirm that you meet this requirement.

2. Description of Service

Our Service provides:

• A web-based platform to create custom forms
• QR code generation linked to each form
• Storage and presentation of form submissions in your dashboard
• Export of submissions to Excel format
• Subscription-based access and pay-per-QR pricing

3. Account Registration

To use the Service, you must register for an account by providing accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

4. Free Trial

We offer a 7-day free trial with the following limits:

• 1 QR code form can be created
• Up to 10 submissions can be collected
• Trial ends after 7 days OR 10 submissions, whichever occurs first

After the trial ends, you will need to subscribe to continue using the Service. No credit card is required for the trial.

5. Pricing and Payment

5.1 Subscription Plan

Our yearly subscription is priced at ₹499 per year, granting access to your dashboard, data viewing, and Excel downloads for 12 months from the date of purchase.

5.2 Per QR Code Charge

Each QR code generation costs ₹399. A QR code, once generated, remains active and collects responses for life, subject to your subscription being active.

5.3 Payment Processing

All payments are processed securely through Razorpay, a PCI-DSS compliant payment gateway. We do not store your card details. You agree to provide accurate billing information and authorize us (via Razorpay) to charge your chosen payment method.

5.4 Taxes

All prices are inclusive of applicable taxes including GST as per Indian tax laws.

5.5 Price Changes

We reserve the right to modify pricing at any time. Existing subscriptions will remain at their original price until renewal.

6. Subscription Expiry

If your subscription expires:

• You can still log in to your account
• You will NOT be able to view submissions, download Excel, or create new forms
• Your existing QR codes may stop accepting new submissions
• Your data will be retained for 90 days, after which it may be deleted

You can renew your subscription at any time to restore full access.

7. Refunds

Please refer to our Refund Policy for refund eligibility and procedures.

8. Acceptable Use

You agree NOT to use the Service for:

• Illegal, fraudulent, or unauthorized purposes
• Collecting data without proper consent from respondents
• Phishing, scams, or spreading malware
• Collecting sensitive information (passwords, payment card details, government IDs) inappropriately
• Sending unsolicited communications (spam)
• Infringing on intellectual property rights of others
• Uploading malicious code or attempting to harm the platform
• Circumventing security features or access controls

Violation may result in immediate account termination without refund.

9. Your Data and Content

You retain ownership of all data and content you submit through the Service. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

You are solely responsible for:

• The legality and accuracy of data you collect
• Obtaining necessary consents from respondents
• Complying with applicable data protection laws (including the DPDP Act, 2023)

10. Intellectual Property

All rights, title, and interest in the Service, including software, design, logos, and trademarks, remain the exclusive property of our company. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written consent.

11. Service Availability

We strive to maintain 99% uptime, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any losses due to such downtime.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms or for any other reason at our sole discretion. Upon termination, your access to the Service will cease immediately.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or platform notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of courts located in India.
